Terms of Service

1. Who we are

AI Essay Grader Europe is operated by ClassX Education B.V. (the “Provider”, “we”, “us”), a company established in the European Union. Contact: legal@classx.eu.

2. The Service

AI Essay Grader Europe provides AI-assisted tools for educators, including essay grading, rubric generation, plagiarism and AI-content detection, scanned-paper OCR, and related functionality. Outputs are produced by large language models and are intended as a teacher’s aid, not as a final assessment of a student’s work.

3. Eligibility and accounts

• You must be at least 18 years old, or the age of digital consent in your country.
• You are responsible for safeguarding your account credentials and for all activity under your account.
• School and institutional administrators may provision accounts for staff under a separate written agreement.

4. Acceptable use

You agree not to:

• Upload content you do not have the right to process (including student work without a lawful basis).
• Attempt to reverse engineer, probe or disrupt the Service.
• Use the Service to generate unlawful, defamatory, or harmful content.
• Bypass rate limits, quotas or technical restrictions.

5. Student data and the teacher’s role

When you upload a student paper, scan or photo, you act as the data controller for that student data. AI Essay Grader Europe acts as a data processor and processes the data only to provide the Service. See our Data Processing Addendum and Privacy Policy.

6. Subscriptions, billing and refunds

Paid plans are billed in advance on a monthly or annual basis in EUR (VAT added where applicable). You may cancel at any time; cancellation takes effect at the end of the current billing period. Statutory consumer withdrawal rights under EU Directive 2011/83/EU apply where the user qualifies as a consumer.

7. Intellectual property

We retain all rights in the Service. You retain all rights in the content you upload. You grant us a limited licence to host, transmit and process that content solely to operate the Service for you.

8. AI output disclaimer

AI-generated grades, feedback and rubrics may contain errors. A qualified educator must review every output before it is communicated to a student or used in a formal assessment. AI Essay Grader Europe is not responsible for academic decisions made on the basis of AI output.

9. Warranties and liability

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, our aggregate liability under these Terms is limited to the fees paid by you in the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

10. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, abuse of the Service, or non-payment. You may close your account at any time; on closure your data is deleted in line with our retention schedule.

11. Changes

We may update these Terms. Material changes will be notified at least 30 days in advance by email or in-product notice.

12. Governing law

These Terms are governed by the laws of the Netherlands. The competent courts of Amsterdam have exclusive jurisdiction, without prejudice to mandatory consumer-protection rules in the user’s country of residence.
